In conversations with patent attorneys and in-house IP teams, the same pattern keeps emerging:

AI tool evaluations typically focus on:
\u2192 GDPR compliance and data processing agreements \ud83d\udcc4
\u2192 Server location for personal data \ud83c\udf0d
\u2192 Standard confidentiality clauses \ud83d\udd10

These are essential \u2013 but they address only one category of risk.

\ud83d\udd0d In IP work, the most sensitive information is rarely personal data.
It is the invention itself.

An invention disclosure.
A patent application draft that has not yet been filed.

If this kind of information is used \u2013 even inadvertently \u2013 to train, fine-tune, or evaluate a large language model, the implications go beyond data protection law:
\u2192 Potential loss of novelty \u26a0\ufe0f
\u2192 Compromised confidentiality before filing
\u2192 Erosion of competitive position \ud83d\udcc9

It is worth noting that many general-purpose AI providers reserve the right to use customer inputs for model improvement, evaluation, or benchmarking, unless specific enterprise terms are in place. For most use cases, this is acceptable. However, this is not the case for invention details\ud83d\udca1.
